Employment Pass (Expatriate)

EMPLOYMENT PASS (EP) MALAYSIA

The Employment Pass (EP) is a work permit that enables an expatriate to take up employment with an organisation in Malaysia. The pass is subject to the contract of employment (up to 60 months). The Expatriate Committee (EC) or relevant authorities must give approval for the foreign talent to fill a position before the issuance of an expatriate Employment.

Duration of Pass

Up to 60 months, depending on the employment contract and upon discretion of the EC.

Work Rights

Expatriates may only work for the company named in the Employment Pass. If they change company, they need to resubmit their application.

There are three types of Employment Passes for Malaysia, depending on your position and salary.

Employment Pass Category 1, which includes key post positions in a company, such as executives, CEOs, technical or managing directors, project managers etc.

  • You must have a monthly salary of at least RM10,000.
  • You must have a work contract of up to five years.
  • The EP can be renewed.
  • You are allowed to hire a Foreign Domestic Helper.

Employment Pass Category 2, which includes managerial and professional positions in a company, such as a marketing or investment manager, lecturers, directors, architects, etc.

  • You must have a salary between RM5,000 and RM9,999.
  • You must have a work contract of up to two years.
  • The EP can be renewed.
  • You are allowed to hire a Foreign Domestic Helper.

  • Registered company in Malaysia with paid-up capital meet minimum requirement for local owned, joint venture, foreign owned which subject to nature of business set by respective ministry.
  • Confirmed employment - The Expatriate Committee (EC) or relevant authorities must give approval for the foreign talent to fill a position before the issuance of an expatriate Employment Pass can be made by the Immigration Department of Malaysia.
  • The company i.e the employer must be the sponsor for the employment pass application
  • The minimum salary for the expatriate must be RM5,000.00 per month and will subject to personal income tax yearly basis by Inland Board Revenue “Lembaga Hasil Dalam Negeri” Malaysia.
  • The needs for hiring expatriate must be justified clearly by the employer.
OTHER PASSES
Only employment pass holder with salary above RM5,000 is eligible to apply

1. Employment Pass holders may apply for a Dependant Pass for the following family members:

  • Spouse
  • Children (under 18 years of age)
  • A legally adopted child (under 18 years of age)
  • Parents / Parents-in-law

2. Employment Pass holders may apply for a Long-Term Social Visit Pass for the following family members:

  • Children (over 18 years of age)
  • A legally adopted child (over 18 years of age)
  • Parents/Parents-in-law

3. Employment Pass holders may apply for a Social Visit (Temporary Employment) for a foreign maid
